Terms of Service

These Terms of Service ("Terms") govern your access to and use of the INSUBORD platform ("Service"), operated by INSUBORD ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

INSUBORD is a multi-tenant SaaS platform that provides businesses with tools for content management, client portals, payment processing, appointment scheduling, email campaigns, and related services. The platform supports agency and client hierarchies, allowing businesses to manage multiple brands and client accounts.

2. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

3. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes and in compliance with all applicable laws
  • Not upload, transmit, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Not attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems
  • Not interfere with or disrupt the integrity or performance of the Service
  • Not use automated tools to scrape, crawl, or extract data from the Service without permission
  • Maintain appropriate backups of your content and data

4. Payment Terms

Certain features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees as described at the time of purchase. Subscriptions automatically renew unless cancelled before the end of the current billing period.

  • Billing: Fees are billed in advance on a recurring basis (monthly or annually, depending on your plan).
  • Refunds: Refund eligibility is evaluated on a case-by-case basis. Contact support for refund requests.
  • Price changes: We may adjust pricing with 30 days' notice before your next billing cycle.
  • Taxes: You are responsible for all applicable taxes unless we are required by law to collect them.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by INSUBORD and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you create or upload to the platform, and grant us a limited license to host, display, and distribute that content as necessary to provide the Service.

6. Limitation of Liability

To the maximum extent permitted by law, INSUBORD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, whether arising from contract, tort, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a reasonable retention period unless required by law to retain it.

9. Indemnification

You agree to indemnify, defend, and hold harmless INSUBORD and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or violation of these Terms.

10. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the revised Terms on this page and updating the "Last updated" date. Your continued use of the Service after modifications are posted constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which INSUBORD operates, without regard to conflict of law principles.
